Cardi B’s Divorce

Cardi B and Offset share a daughter. And they married in September, 2017. So Cardi B is filing for divorce. And it’s not the first time, it’s the second.

Cardi and Offset have endured a turbulent relationship. Cardi spoke to Vogue in December 2019. And, according to the singer, ‘when me and my husband got into our issues-you know, he cheated and everything- and I decided to stay with him and work together with him, a lot of people were so mad at me; a lot of women felt disappointed in me’

So, Cardi B is 27 years old. And Offset, her husband of three years, is 28. Kulture Kiari is their two year old daughter. So, Cardi is trying to obtain primary physical custody of Kulture. She also wants child support.

And the divorce hearing is organised, apparently, for November 2, 2020.

How is child custody determined in California law?

In California, child custody is determined in relation to the best interest of the child.

So both parents start with equal custody rights, and the judge is not allowed to consider the parent’s sex when making custody decisions.

And a ‘child’s best interest’, in California, is decided by two key factors. And these are the child’s. Health, safety and welfare, as well as the benefit that the children receive from ongoing and continuous connection with both parents.

In California, courts are obliged to consider the desires of children old enough to make a responsible choice in relation to custody.
