After 27 years as a Public Defender, I encountered a variety of criminal cases, yet one area remained relatively unexplored: assisting individuals entangled in the criminal justice system before facing formal charges. While most Public Defenders engage with clients post-charge, many individuals suspected of crimes never face formal charges due to factors like insufficient evidence or early legal intervention.
Transitioning to a prosecutor role for nearly 4 years, overseeing cases involving law enforcement and justice system members, provided invaluable insights into the intricate process of case filing and strategies for prevention. One key takeaway – dismissing a filed case proves significantly more challenging than averting its initial filing. Once filed, a case gains momentum, making dismissal a bureaucratic labyrinth compared to prevention.
Drawing from my experience managing complex and politically sensitive cases, I recently undertook two new cases aimed at preventing criminal filings. One case, still ongoing and demanding extensive effort, shows promising progress. The other, swiftly resolved, marked my first success in avoiding a filing. Using skills honed through my defense and prosecution roles, and using my connections with law enforcement, I averted a filing and safeguarded an individual with no criminal history from arrest, charges, or a conviction, ensuring a clean record unaffected by background checks or job applications.
In a digital age where information endures, proactive measures against potential criminal filings are crucial. If you know someone who is concerned about potential looming charges, encourage them to act preemptively and seek legal counsel to prevent a filing, reduce the severity of future charges, or pave the way for a favorable resolutions. Passively waiting is not the answer; prompt engagement with a criminal defense attorney who has this experience and connections can make all the difference.
